Please read these Booking Terms & Conditions carefully before making a booking. They contain vital information regarding your legal rights, financial protections, and contractual obligations when purchasing travel arrangements from us.

Your contract is with The Ocean Within Travel Ltd (“the Company”, “we”, “us”, “our”). Depending on the nature of the travel services you purchase, our legal obligations and your contract structure differ as follows:

  • Organised Packages (Operator Division): Where we design, combine, and market our own multi-day experiential land-only travel packages, staycations, or wellness retreats that incorporate combinations of elements such as accommodation and land transport, we act strictly as the “Organiser” under the Package Travel and Linked Travel Arrangements Regulations 2018.
  • Single Services & Retail Bookings (Agent Division): Where we act as a retail ticketing manager, booking manager, or re-seller of pre-arranged standalone holidays, tours, cruises, or events supplied by third-party principal operators, we act exclusively as a Retail Agent. In these instances, your direct contract is with the principal third-party supplier, and their specific corporate terms and conditions apply directly to your booking.
  • Deposit: A non-refundable commitment deposit of 20% of the total travel price is required at the time of reservation to secure your place.
  • Balance Due Date: The remaining balance of your booking must be paid in full no later than 60 days prior to your scheduled departure date.
  • Late Bookings: For any reservations requested within 60 days of departure, full payment must be settled immediately at the exact time of booking.
  • Binding Contract: A binding legal agreement is created only when we formally issue a custom Confirmation Invoice to the lead passenger. It is your responsibility to review all confirmation fields immediately (ensuring legal names exactly match passport details) and alert us to any administrative discrepancies within 24 hours.

We make every reasonable effort to ensure that all information, structural itineraries, and prices published across our websites, brochures, and digital marketing materials are factually accurate. However, clerical errors may occasionally manifest. We reserve the right to correct administrative pricing flaws or update written statements, and will inform you immediately of any material modifications affecting your confirmed arrangements.

Price Variation Policy: We reserve the right to apply price variations to your confirmed booking up to 20 days before departure solely to cover volatile external shifts in government-imposed taxes, airport or port landing levies, or currency exchange parameters. We will completely absorb any price inflation up to 2% of your package cost. Should an unavoidable surcharge increase your overall trip cost by more than 8%, you hold the right to cancel the contract and receive a full 100% refund of all monies paid to us.

If you wish to terminate or cancel your travel arrangements, the request must be submitted directly to us in writing via email at oceanswithintravel@gmail.com. Standard cancellation charges are assessed based on a stepped sliding scale relative to the date your written notification is formally received:

Independent visa processing fees, third-party carrier administrative charges, or supplier-specific booking deposits passed immediately to upstream operators are entirely non-refundable once committed.

You retain the right to transfer your booking space to an alternative individual who satisfies all package conditions, provided we are given at least 7 days’ written notice before departure. Transfers are strictly subject to third-party supplier rules. If an underlying venue or service provider treats a name change as a full cancellation, standard cancellation charges above apply, and the lead passenger remains jointly liable for any supplier fees incurred.

While we always endeavour to operate all scheduled packages as advertised, we reserve the operational right to modify itineraries or cancel packages. If we must execute a significant structural modification to your land package or cancel it completely (except in cases of customer non-payment), you will immediately be offered the choice of:

  • (a) Accepting the updated structural itinerary arrangements;
  • (b) Accepting an alternative travel arrangement of an equivalent or superior standard; or
  • (c) Receiving a full refund of all monies paid to us, which will be processed strictly within 14 days.
⚠ Critical Flight Disclaimer: All tour packages designed and arranged directly by the Company are structured strictly on a land-only basis and exclude all international and domestic flights. It is your absolute, sole responsibility to secure appropriate air travel to reach the specified destination city.

We mandate that all participants arrive at their destination city at least 24 hours prior to the scheduled tour or cruise itinerary start time. We accept zero financial liability for missed package components, itinerary curtailment, or structural losses caused by independent flight delays, airline cancellations, or logistical transit issues.

  • Passengers must possess a valid passport with a minimum of 6 months’ validity beyond their final return date, alongside all required entry visas and health declarations.
  • We accept no financial liability if you are denied boarding, transit, or national entry by border officials due to incorrect or missing personal travel documentation.
  • You confirm that all individuals listed under your booking are physically fit and capable of engaging in the designated land activities, sightseeing itineraries, or wellness workshops.
  • Any active medical issues, structural mobility restrictions, or acute dietary requirements must be formally declared in writing during the initial booking sequence.
🔒 Your Money is Protected: The Ocean Within Travel Ltd ensures comprehensive security for all consumer funds via our active registration with Protected Trust Services (PTS).

All customer package payments are deposited directly into an independent, securely monitored Trust Account overseen by professional independent trustees. These funds are legally segregated from our operational corporate accounts and cannot be released until your holiday is successfully delivered.

Furthermore, forward disbursements paid out from the trust to lock in destination resources (such as hotels and transport operators) are fully backed by comprehensive Supplier Failure Insurance (SFI), protecting your funds completely against third-party insolvency.

Our direct package contracts are strictly confined to pre-arranged hotel accommodation, scheduled ground transfers, and our designated workshop/life-coaching facilitation. The Ocean Within Travel Ltd does not operate, sell, or accept payments for any high-risk activities or local excursions in resort. Any optional excursions, local tours, or high-risk activities booked by a consumer on the ground are handled entirely as private agreements made independently between the customer and the local licensed provider.

Our operational liability is strictly bounded in accordance with prevailing international treaties, including the Athens Convention (governing marine transport segments) and the Montreal Convention (governing land/air carrier segments).

Force Majeure: We cannot accept liability, pay financial compensation, or offer refunds for non-refundable components where our contract performance is delayed, altered, or blocked by events constituting Force Majeure. This encompasses natural disasters, acts of war, terrorism, civil unrest, national strikes, global health pandemics, or extreme/adverse weather anomalies.

We and our accommodation partners reserve the absolute right to terminate your travel arrangements immediately if your physical conduct is deemed unsafe, illegal, or causes severe distress, harassment, or property damage to third parties. No refunds or emergency repatriation funding will be provided under such circumstances.

When traveling via third-party principal cruises or entering specific international retreat zones managed via our Agent division, passengers are contractually bound to comply with all local cultural laws, regional codes of conduct, and vendor passenger rules (including modesty dress parameters and behavioural guidelines). Failure to respect regional cultural frameworks may result in boarding or accommodation access being denied immediately by local authorities or suppliers without recourse.

⚠ Non-Negotiable Requirement: Comprehensive travel insurance is a mandatory, non-negotiable condition of booking with the Company.

Your insurance policy must be active from the moment your deposit is processed and must feature explicit coverage parameters for:

  • Full package cancellation
  • Medical treatment expenses
  • Emergency medical evacuation
  • Maritime evacuation (where applicable)
  • Supplier Default

If you elect to travel without adequate insurance protection, the Company will not be held responsible for financial losses that would have otherwise been covered by an appropriate policy.

These booking conditions and all corresponding contractual agreements are governed exclusively by the laws of England and Wales. Any legal claims, disputes, or arguments arising out of these terms fall under the exclusive jurisdiction of the courts of England and Wales.
